Introduction
Welcome to SEEN ("Platform", "SEEN", "we", "our", or "us"), an influencer marketing and creator marketplace connecting creators, brands, and agencies across the MENA region.
By accessing or using the SEEN platform, website, applications, or services, you agree to comply with and be legally bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not use the Platform.
Eligibility
To use SEEN, you must meet all of the following requirements:
- Be at least 18 years old
- Have the legal authority to enter binding agreements
- Provide accurate and complete registration information
- Comply with all applicable laws and regulations in your country
Businesses, agencies, and creators may use the Platform only for lawful commercial purposes.
Platform Structure & Services
SEEN operates through three primary user flows:
Users may register as a creator, a brand, an agency, or multiple account types where applicable. SEEN does not act as an employer or direct representative of creators, brands, or agencies.
User Accounts
Users are encouraged to register using a professional business or domain email address where applicable. Personal email addresses may still be accepted at SEEN's discretion. Website links are optional during registration.
Users are responsible for:
- Maintaining the confidentiality of login credentials
- All activity conducted under their account
- Keeping account information accurate and updated
Regional Compliance & Advertising Verification
Users operating in jurisdictions requiring advertising permits, influencer licenses, or campaign approvals are solely responsible for maintaining valid documentation.
For example, users operating within the UAE may be required to hold:
- Advertising permits
- Influencer licenses
- Media or promotional approvals
- Applicable advertising registration numbers
SEEN may request verification documents including permit numbers, advertising approvals, and government-issued registration details. SEEN may also provide optional support regarding permit assistance and compliance guidance.
Creator Terms
Creators may upload videos, images, social links, and portfolio materials; set pricing and rate cards; receive campaign offers; and submit content through the Platform.
Creators are solely responsible for the accuracy of their portfolio and audience information, compliance with advertising disclosure laws, and ownership or authorization of uploaded content.
SEEN offers Trial, Essential, and Pro creator plans. Creator subscriptions may be billed monthly or annually, renew automatically unless canceled before renewal, and are non-transferable. Commission percentages are deducted from creator earnings based on the selected subscription plan.
Creator payouts are processed after campaign approval and escrow release, net of platform commissions and applicable fees, and may require identity verification before withdrawal. SEEN may delay payouts in cases involving fraud investigations, disputes, or violations of these Terms.
Brand & Agency Terms
Brands and agencies may post campaign briefs, browse creators, send offers, review creator submissions, and request revisions within agreed limits. Campaign details, deadlines, deliverables, usage rights, and budgets must be clearly stated before confirmation.
Agency plans may include multiple client brands, team seat allocations, multi-brand dashboards, and shared collaboration management tools. Seat availability and feature access depend on the selected package.
For paid campaigns, funds are held securely in escrow before work begins. Escrow is released after content approval or dispute resolution. SEEN deducts applicable platform commissions before creator payout.
Brands and agencies agree not to circumvent the Platform to avoid fees, request unlawful or misleading content, or use creator content beyond agreed usage rights.
Marketplace & Matching System
SEEN provides an intelligent matchmaking and discovery system. Creators may submit interest in campaigns, receive campaign recommendations, and browse marketplace opportunities. Brands and agencies may receive creator interest submissions, browse suggested creators, and contact creators based on subscription access and matching eligibility.
Platform Fees & Pricing
All fees may be displayed locally but settled in USD. SEEN reserves the right to modify subscription pricing, adjust commissions, and introduce new paid features. Users will be notified before material pricing changes take effect. Subscription payments are generally non-refundable except where required by law.
Escrow & Disputes
Campaign payments are held in escrow until content is delivered, the brand approves submission, or the dispute window expires.
Brands and agencies have a 7-day dispute window following delivery. Disputes may include failure to deliver agreed content, major deviations from campaign requirements, delayed payment issues, suspected fraud or misuse, or violations of agreed campaign terms.
SEEN may review messages, campaign briefs, uploaded submissions, timestamps, approval history, and platform activity logs. Where applicable, dispute tickets may be integrated into SEEN's internal operational systems, including third-party tools such as Odoo. SEEN's dispute decisions are final unless otherwise required by applicable law.
Messaging & Communications
In-platform messaging availability depends on subscription type. Free trial users may have limited or restricted messaging access. Certain contact information may remain restricted until collaboration requirements are met.
Users agree not to harass or threaten others, send spam or malicious content, share harmful or misleading material, or attempt to move transactions off-platform to avoid fees. SEEN may monitor communications for safety, fraud prevention, moderation, dispute handling, and policy enforcement.
Ratings, Reviews & Moderation
Following completion of a collaboration, creators, brands, and agencies may leave ratings or reviews regarding their experience. SEEN reserves the right to moderate, approve, reject, or remove abusive, misleading, fraudulent, or inappropriate feedback. Public ratings may not appear immediately and may be subject to administrative approval.
Content Ownership & Usage Rights
Creators retain ownership of their original content unless otherwise agreed in writing. Brands receive only the usage rights explicitly agreed upon within the campaign.
Users may not reuse content outside agreed permissions, sell or sublicense content without authorization, or upload copyrighted content they do not own. By uploading content, users grant SEEN a limited license to host and display content within the Platform, operate and improve the service, and promote the Platform where applicable.
Prohibited Activities
Users may not engage in the following:
- Fraud or deceptive conduct
- Purchase of fake followers or engagement
- Impersonating another person or business
- Uploading unlawful, defamatory, hateful, or infringing content
- Attempting to hack, scrape, or disrupt the Platform
- Bypassing platform payments or commissions
Verification & Compliance
SEEN may request government-issued identification, business verification documents, payment verification, tax-related information where legally required, and advertising permits or campaign approval documentation. Failure to provide requested information may limit account functionality, restrict marketplace visibility, or delay campaign approvals or payouts.
Administrative Access & Platform Management
SEEN may provide administrative dashboard access with role-based permissions and limited seat allocations. Certain agency subscription plans may include multiple team seats, restricted admin permissions, shared dashboards, and multi-brand management tools. Super administrators may access restricted information where necessary for compliance, fraud prevention, support, dispute resolution, and operational management.
Refunds & Cancellations
Users may cancel subscriptions at any time. Cancellation prevents future renewals but does not automatically refund previously charged amounts.
Refund eligibility depends on campaign status, content delivery stage, and dispute findings. Approved refunds may be processed partially or fully.
Intellectual Property
All Platform branding, software, designs, features, logos, systems, and visual assets are the property of SEEN unless otherwise stated. Users may not copy or reproduce Platform materials, reverse engineer the Platform, or use SEEN branding without written permission.
Third-Party Services
SEEN may integrate with third-party services including payment providers, social media platforms, analytics providers, verification systems, and operational tools such as Odoo. SEEN is not responsible for third-party outages, policies, or actions.
Limitation of Liability
To the maximum extent permitted by law, SEEN shall not be liable for indirect or consequential damages, loss of profits or revenue, failed collaborations, content performance, user-generated content, or Platform downtime or interruptions. SEEN does not guarantee campaign results, audience engagement, or financial outcomes.
Indemnification
Users agree to indemnify and hold harmless SEEN and its affiliates from claims, liabilities, losses, or damages arising from user content, violation of these Terms, or breach of laws or third-party rights.
Account Suspension & Termination
SEEN may suspend or terminate accounts at its discretion for policy violations, fraud risk, abuse of the Platform, or illegal activities. Users may also request account deletion subject to outstanding obligations.
Changes to the Terms
SEEN may update these Terms periodically. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
Governing Law
These Terms shall be governed in accordance with the laws applicable in the United Arab Emirates unless otherwise required by local law.
